Terms of service
OVERVIEW
This website www.rebel-aura.co.uk (the "Site") is operated by Laura Hogarth, trading as Rebel Aura ("Rebel Aura", "we", "us", "our"), a sole trader based in the United Kingdom. You can reach us at rebelaura@outlook.com or via our Contact Us page.
By visiting our Site and/or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including any additional terms and policies referenced here or available by hyperlink. These Terms apply to all users of the Site, including browsers, customers, and contributors of content.
Please read these Terms carefully before using the Site. If you do not agree with any part of these Terms, you should not use the Site.
Nothing in these Terms affects your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If any part of these Terms conflicts with those statutory rights, your statutory rights take priority.
We may update these Terms from time to time. The current version will always be available on this page, and continued use of the Site after changes are posted means you accept the updated Terms.
Our store is hosted by Shopify Inc., who provide the online e-commerce platform that allows us to sell our products to you.
SECTION 1 – ELIGIBILITY
By using this Site, you confirm that you are at least 18 years old, or that you are using the Site under the supervision of a parent or guardian. You agree not to use our products or the Site for any unlawful purpose, and not to violate any laws applicable to you (including UK copyright and consumer protection law).
SECTION 2 – GENERAL CONDITIONS
We reserve the right to refuse service to anyone, for legitimate reasons, at any time.
You understand that data you submit (excluding payment card details) may be transferred unencrypted and may involve transmissions over various networks, and may be changed to conform to technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer.
You agree not to reproduce, duplicate, copy, sell, resell, or otherwise exploit any part of the Service without our express written permission.
Headings in these Terms are for convenience only and do not affect their interpretation.
SECTION 3 – ACCURACY OF INFORMATION
We aim to keep information on the Site accurate and up to date, but we do not guarantee that all content is complete, current, or error-free. This does not affect your right, under the Consumer Rights Act 2015, to receive goods that match the description given to you.
The Site may contain historical information, which is provided for reference only. We may update the Site's content at any time but are not obliged to do so.
SECTION 4 – PRICES AND CHANGES TO THE SERVICE
All prices are shown in GBP (£) and are inclusive of any applicable taxes unless stated otherwise. We are not currently VAT registered. The total price you pay, including delivery charges, will always be made clear to you before you complete your order – we do not add hidden charges at checkout.
Prices for our products may change, but any change will not affect an order you have already placed and had confirmed.
We may modify or discontinue the Service (or any part of it) at any time. We are not liable to you or any third party for any such modification, suspension, or discontinuation, except where this would conflict with your statutory rights.
SECTION 5 – PRODUCTS
Certain products may be available exclusively online and may be limited in quantity. We have made every effort to display the colours and details of our products as accurately as possible, but we cannot guarantee that your device's display will show colours perfectly accurately.
We reserve the right to limit the sale of our products to any person or region, and to discontinue any product at any time, but this will not affect orders already placed and confirmed.
Under the Consumer Rights Act 2015, goods we supply must be as described, of satisfactory quality, and fit for purpose. Nothing in these Terms limits that right.
SECTION 6 – YOUR ORDER, ACCOUNT AND BILLING INFORMATION
We reserve the right to refuse or cancel any order, for example where we suspect fraud, an error in pricing or product information, or a breach of these Terms. If we cancel an order after payment has been taken, we will refund you in full.
You agree to provide current, complete, and accurate information when placing an order, and to keep your contact and payment details up to date so we can fulfil your order and contact you if needed.
For details of your rights around returns and refunds, please see our Refund Policy, which includes your 14-day statutory right to cancel most orders under the Consumer Contracts Regulations 2013.
SECTION 7 – THIRD-PARTY TOOLS AND LINKS
We may give you access to third-party tools that we do not monitor or control. Any use of these tools is at your own risk, and you should check the third party's own terms before using them.
The Site may contain links to third-party websites that are not affiliated with us. We are not responsible for the content, accuracy, or practices of third-party sites, and including a link does not mean we endorse them.
SECTION 8 – YOUR COMMENTS AND FEEDBACK
If you send us comments, ideas, or suggestions (for example, through reviews or social media), you agree that we may use, edit, and share them without restriction or compensation, provided we do not attribute personal details you haven't agreed to share.
You agree that anything you send us won't be unlawful, threatening, defamatory, obscene, or infringe anyone else's rights, and won't contain viruses or malware. You're responsible for the accuracy of anything you submit.
SECTION 9 – YOUR PERSONAL INFORMATION
Any personal information you provide through the Site is handled in line with our Privacy Policy and UK data protection law (UK GDPR and the Data Protection Act 2018).
SECTION 10 – ERRORS AND CORRECTIONS
Occasionally the Site may contain typographical errors or inaccuracies relating to product descriptions, pricing, or availability. We reserve the right to correct these and to update or cancel orders affected by such errors, even after you've submitted an order, though we'll always contact you first if this affects an order you've placed.
SECTION 11 – PROHIBITED USES
You may not use the Site: for any unlawful purpose; to violate any applicable laws or regulations; to infringe our or anyone else's intellectual property rights; to harass, abuse, or discriminate against anyone; to submit false or misleading information; to transmit viruses or malicious code; to collect or track others' personal information without consent; or to interfere with the security of the Site. We may terminate your access to the Service if you breach this section.
SECTION 12 – LIABILITY
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited under English law – including your rights under the Consumer Rights Act 2015.
Subject to the above, we do not guarantee that your use of the Service will be uninterrupted or error-free, and to the fullest extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of the Site or our products, provided we have taken reasonable care in providing them.
The Service and products are provided on an "as available" basis. This does not affect the statutory quality guarantees you're entitled to as a consumer.
SECTION 13 – INDEMNITY
You agree to reimburse us for any reasonable losses or costs (including legal fees) we incur as a direct result of your breach of these Terms or your misuse of the Site, except where this would be unfair or unreasonable under UK consumer protection law.
SECTION 14 – SEVERABILITY
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be removed or limited to the minimum extent necessary, and the rest of these Terms will remain in full effect.
SECTION 15 – TERMINATION
These Terms apply for as long as you use the Site. You may stop using the Site at any time. We may suspend or end your access to the Service if you seriously or repeatedly breach these Terms, though obligations that naturally continue (such as payment for orders already placed) will survive termination.
SECTION 16 – ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, make up the whole agreement between you and us regarding use of the Site, replacing any earlier agreements on the same subject.
SECTION 17 – GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere in the UK (Scotland or Northern Ireland), you may bring proceedings in the courts of your home jurisdiction instead, and mandatory consumer protection laws of your home nation will still apply to you.
SECTION 18 – COMPLAINTS AND DISPUTE RESOLUTION
We hope you never need to, but if you have a complaint, please contact us first at rebelaura@outlook.com or via our Contact Us page so we can try to put things right. You can also get free, independent consumer advice from Citizens Advice (www.citizensadvice.org.uk) or the Citizens Advice consumer helpline.
SECTION 19 – CONTACT INFORMATION
Questions about these Terms of Service should be sent to us via our Contact Us page, or by email to rebelaura@outlook.com.
